A BILL to amend and reenact section one, article two, chapter
fifty-five of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to adverse
possession; and changing the time limitation for entry on or
in which an action to recover land may be commenced.
Be it enacted by the Legislature of West Virginia:
That section one, article two, chapter fifty-five of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2. LIMITATION OF ACTIONS AND SUITS.
§55-2-1. Entry upon or recovery of lands.
No person shall may make an entry on, or bring an action to
recover, any land, but unless the entry is made or the action is
commenced within ten twenty years next after the time at which the right to make such the entry or to bring such the action
shall have first accrued to himself the person or to some other
person through whom he the person claims.
NOTE: The purpose of this bill is to change the time it
takes to acquire property by adverse possession from ten years to
twenty years.
